We may see some interesting legal battles and maneuvering associated with replacing Rep. Chaffetz, since Utah election law provides no guidance into how the irregular election should be held. The special election law merely states that, “the governor shall issue a proclamation calling an election to fill the vacancy."
Gov. Gary Herbert (R) has said he will call an election post vacancy and believes the parties should nominate by primary. A contingent in the legislature, however, favors the convention process. Therefore, it may be sometime before an agreement is reached, thus this special election may have a long cycle.
